New Court Fees for Probate and Lasting Powers of Attorney

New Court Fees for Probate and lasting Powers of Attorney have been announced recently.

The Court and Public Guardian Fees (Miscellaneous Amendments) Order 2025 have made changes to the Court fees paid when applying for probate and lasting power of attorney.

These changes will be implemented on November 17th 2025.

What is Changing?

The Court fees for probate applications will remain the same at £300 for estates with a value of over £5,000.

However, sometimes in the probate process documents relating to the deaths of other members of the family and the office copies of their grant of probate need to be ordered as these are relevant to the current probate.

From 17th November 2025 the fee for an office copy of a grant of probate will increase from £1.50 to £16.

Why It Matters

Executors generally need to order several office copies, as these are required by banks, life assurance companies, share registrars, Land Registry, and other organisations to release assets in an Estate.

We will try to;

  • Order only what is necessary as some banks and registrars now accept scanned or sealed digital copies from solicitors.
  • We will ask a bank or financial institution to return the original document to us once noted  so the original office copy can be used again.

Clients should try to;

  • Keep copies of documents safe in an accessible place that your Executors may need access to in the future when dealing with your estate, such as a copy of the Will and Grant in the estate of your late spouse.

 Lasting Power of Attorney (LPA) fees

The application fees for a LPA are also going up on 17th November 2025 by £10 from £82 to £92.
