The Danger of DIY Divorce

The danger of a DIY divorce may not be apparent, especially with the move to online divorce becoming increasingly popular.

The temptation to avoid seeking legal advice and have a ‘quick and easy’ divorce is all too familiar.

A family Court judge has recently witnessed first-hand the pitfalls of unregulated providers attempting to assist with the divorce process.

As the law currently stands, it is possible to obtain a divorce based on the other person’s behaviour. This involves citing examples of the behaviour to prove that the marriage has broken down irretrievably.  Earlier this month, a judge dismissed 28 divorce petitions from the same company after it was established that the examples of behaviour were ‘absolutely identical’ to each other. The judge has set a benchmark that a one-size fits all approach is not appropriate and will not be tolerated. This has resulted in the individuals affected being back at square one and having to submit another divorce petition to the court and pay a further fee of £593.
